Terms & Conditions

1. DEFINITIONS
1.1 Publisher: The owners and operators of the Publication, D.C. Houghton Ltd, registered in England and Wales (registered number 7490482) with its registered office at 20-22 Wenlock Road, N1 7GU, London, UK.
1.2 Publication: WorldECR magazine.
1.3 Subscription Period: The period set out in the invoice sent to you or your organisation.
1.4 Subscription Fee: The current subscription fee as set out in any invoice sent to you or your organisation.
1.5 User: The individual which has paid the Subscription Fee.
1.6 Licensed Firm: The government agency, company, library or law firm who has paid the Subscription Fee.
1.7 Single-site subscription: the subscription which provides copies of the Publication to employees within one office or geographic location of the Licensed Firm.
1.8 Multi-site subscription: the subscription which provides copies of the Publication to employees within more than one office or geographic location of the Licensed Firm.

2. GENERAL CONDITIONS OF USE
2.1 All rights in the Publication belong to the Publisher or its third-party licensors and are protected by copyright, trademarks, service marks and/or other proprietary rights and laws of the United Kingdom and other countries. All individual articles, columns, emails and other elements of the Publication are also copyright works and you agree to abide by all applicable copyright and other laws, as well as any additional copyright notices or restrictions contained in the Publication or in these Terms and Conditions. The Publisher may license third parties to use the Publication in its sole discretion.
2.2 You agree to use the Publication solely for your own/Licensed Firm’s use and benefit and not for resale or other transfer or disposition to any other person or entity. You further agree not to use, transfer, distribute or dispose of any part of the Publication in any manner that might compete with the business of the Publisher.
2.3 You accept that the Publication is not to be used for transactions or the provision of legal advice.
2.4 Subject to the above, you may retrieve and display the Publication on a computer screen, print individual pages on paper and store such pages in electronic form on disk, on a server or other storage device connected to a network but you may not reproduce, modify or exploit any of the Publication for commercial profit other than would be ordinarily made in the course of your business.
2.5 Any breach of the Conditions of Use will entitle the Publisher, in addition to any other remedy available, to terminate this Licence immediately. In such event no part of the annual fee already paid will be repayable to you.

3. USER LICENCE
3.1 Single-site user licence: Subject to the above, you or employees of the Licensed Firm or in the case of an educational establishment the employees or students or faculty members of that establishment may retrieve and display the Publication on a computer screen, print individual pages on paper, and store such pages in electronic form on disk or on any server or other storage device connected to a network accessible to you or employees of the Licensed Firm within a single office or geographical location belonging to the Licensed Firm but you or employees of the Licensed Firm may not copy, forward or distribute copies or make available the Publication or copies of the Publication to individuals who are employed by the Licensed Firm in other offices or geographical locations nor to individuals who are not employed by the Licensed Firm without the prior consent of the Publisher with the exception of visitors or members of the public to the Licensed Firm’s office or geographical location when the Licensed Firm is an educational establishment or library.
3.2 Multi-site user licence: Subject to the above, you or employees of the Licensed Firm or in the case of an educational establishment the employees or students or faculty members of that establishment may retrieve and display the Publication on a computer screen, print individual pages on paper, and store such pages in electronic form on disk or on any server or other storage device connected to a network accessible to employees of the Licensed Firm within more than one office or geographical location belonging to you or employees of the Licensed Firm but you or employees of the Licensed Firm may not copy, forward or distribute or make available the Publication or copies of the Publication to individuals who are not employed by the Licensed Firm without the prior consent of the Publisher with the exception of visitors or members of the public to the Licensed Firm’s offices or geographical locations when the Licensed Firm is an educational establishment or library.

4. DISCLAIMER
4.1 The Publication is distributed on an ‘as is’ basis without warranties of any kind, either express or implied.
4.2 Information may be incorrect or out of date.
4.3 Information may not constitute a definitive or complete statement of the law.
4.4 Materials are not intended to constitute legal advice in any specific situation.
4.5 You may not be able to access the Publication or any materials in it when you want to.
4.6 The Publisher may change or withdraw part of the Publication.
4.7 The Publication may not be compatible with your browser or computer configuration.

5. LIMITATION OF LIABILITY
The liability of the Publisher, and the liability of any employees to you or any other party for any losses or damages whatsoever arising in connection with the publication (whether under this Licence or other contract or in consequence of their misrepresentation, misstatement or tortious act or omission including negligence) is limited to damages of an amount equal to the subscription fee.

6. TERMINATION
6.1 If you are in breach of these terms the Publisher may terminate this licence immediately upon giving you written notice.
6.2 The Publisher will terminate this licence at the end of the Subscription Period by giving you notice unless you renew your subscription at the then current fee.
6.3 Following completion of the registration process and receipt of payment of the Publications Fees we grant you and those persons you identify as the User and/or Licensed Firm during the registration process and subsequent correspondence (the “Authorised Users”) a non-excusive and non-transferable licence to access the Publication for the purposes set out below. You may only appoint Authorised Users who are employees of the Licensed Firm.
6.4 The Publication is sold on the basis that no returns will be accepted or refunds given unless the Publication can be shown to be faulty and not reasonably rectified.

7. GOVERNING LAW
This Licence is governed by English law and you submit to the non-exclusive jurisdiction of the English courts.

8. PRIVACY POLICY
8.1 The Publisher and Publication will comply with the relevant English data protection laws, so normally any personal details provided to us will not be disclosed to third parties without the User’s consent.
8.2 If the Publisher is requested by authorised third parties or regulatory or governmental agencies investigating illegal activities to provide information concerning Users’ activities whilst using the Publication, the Publisher shall do so.
8.3 The Publisher will disclose Users’ personal data if the Publisher is compelled to do so by law.
8.4 The Publisher reserves the right to notify or provide such information to the relevant authority if, in its sole opinion, the Publisher believes an emergency, illegal activity or some other reasonable basis exists for doing so.
8.5 The Publisher reserves the right to store and use Users’ personal data solely for its own internal purposes and the Publisher further reserves the right to access, monitor and retrieve password-protected information in order to fulfil our obligations in these terms and conditions.
