US amends EAR to reflect MTCR updates

The US Department of Commerce’s Bureau of Industry and Security (‘BIS’) has amended the Export Administration Regulations (‘EAR’) to reflect the 2017 Missile Technology Control Regime (‘MTCR’) plenary agreements. The MTCR is a multilateral export control regime among 35 countries which seeks to put controls on the export of goods and technology that could be used for weapons of mass destruction.

The changes adopted by final rule in the Federal Register integrate amendments made at the October 2017 Plenary in Dublin, Ireland, and the May 2017 Technical Experts Meeting (‘TEM’) in Stockholm, Sweden, into the EAR.

Seventeen export control classification numbers (‘ECCNs’) have been revised to align missile technology controls on the Commerce Control List (‘CCL’) with the MTCR Annex. The ECCNs are codes assigned by BIS to items such as technology and software, which indicate the type of export control assigned to the items, depending on the end-user.
